1. Acceptance of Terms

Welcome to OctaCoach! These Terms of Service ("Terms") govern your access to and use of the OctaCoach mobile application and related services (collectively, the "Service").

By downloading, installing, or using OctaCoach, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

OctaCoach is a martial arts training companion app that provides:

• Customizable round timers with voice coaching
• Strike combination generators for 8 martial arts disciplines
• Technique library with step-by-step instructions
• Progressive training drills from beginner to expert levels
• Training log with analytics and progress tracking
• Belt progression system and streak monitoring
• Personalized workout plans based on user preferences

3. Account and Subscriptions

3.1 Free and Pro Tiers

OctaCoach offers two service tiers:

• Free Tier: Limited access to basic features, timers, drills, techniques, and training log (up to 20 entries)
• Pro Tier: Full access to all features, unlimited training log, advanced analytics, CSV export, and premium content

3.2 Subscription Plans

Pro tier is available through the following subscription options:

• Pro Monthly: $4.99/month, billed monthly, cancel anytime
• Pro Annual: $29.99/year, billed annually, includes 7-day free trial, save 50% vs monthly
• Lifetime: $79.99 one-time payment, permanent access to all Pro features

3.3 Free Trial

The Pro Annual plan includes a 7-day free trial. You will not be charged until the trial period ends. You may cancel at any time during the trial period without charge.

3.4 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

3.5 Managing Subscriptions

Subscriptions are managed through your Apple App Store or Google Play Store account:

• iOS: Settings → [Your Name] → Subscriptions
• Android: Play Store → Menu → Subscriptions

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

3.6 Refund Policy

All purchases are processed through the App Store or Google Play Store and are subject to their respective refund policies:

• Apple App Store: Request refunds at reportaproblem.apple.com
• Google Play Store: Request refunds through the Play Store app or play.google.com/store/account/subscriptions

OctaCoach does not process payments directly and cannot issue refunds. All refund requests must go through the respective app store.

4. User Responsibilities

4.1 Accurate Information

You agree to provide accurate, current, and complete information when creating your profile (age, weight, height, fitness level). Accurate information ensures personalized workout plans are appropriate for your fitness level.

4.2 Medical Consultation

Important: Consult with a physician or qualified healthcare professional before beginning any exercise program, especially if you have any pre-existing medical conditions, injuries, or concerns about your health.

4.3 Proper Use of Techniques

Martial arts training carries inherent risks. You agree to:

• Train in a safe environment with adequate space and proper surfaces
• Use appropriate protective equipment when necessary
• Follow technique instructions carefully and practice proper form
• Listen to your body and stop if you experience pain or discomfort
• Seek professional instruction from qualified martial arts instructors for advanced techniques

4.4 Prohibited Activities

You agree NOT to:

• Reverse engineer, decompile, or disassemble the app
• Scrape, copy, or redistribute app content without permission
• Share your subscription account with others
• Use the app for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the Service

5. Intellectual Property

5.1 App Content Ownership

All content in OctaCoach, including but not limited to text, graphics, logos, images, videos, technique descriptions, training programs, and software, is the property of OctaCoach and is protected by copyright, trademark, and other intellectual property laws.

5.2 User-Generated Data Ownership

You retain ownership of your personal training data (workout logs, progress records, custom plans). OctaCoach does not claim ownership of your data.

5.3 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the OctaCoach app for personal, non-commercial purposes in accordance with these Terms.

6. Disclaimers

6.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

6.2 Not Medical or Professional Advice

Disclaimer: OctaCoach is NOT a substitute for professional martial arts instruction, medical advice, or personal training services. The app provides general information and guidance only. Always consult qualified professionals for personalized advice.

6.3 Physical Activity Risks

Martial arts training and physical exercise carry inherent risks of injury. You acknowledge and accept these risks by using the Service. We recommend:

• Warming up properly before training
• Starting at an appropriate difficulty level
• Progressing gradually to avoid overtraining
• Using proper technique and form
• Taking rest days for recovery

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCTACOACH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any injuries, damages, or health issues arising from use of the Service
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Errors or omissions in app content or functionality
• Unauthorized access to or alteration of your data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Termination

8.1 Termination by You

You may stop using the Service at any time by:

• Uninstalling the app from your device
• Cancelling your subscription (if applicable)
• Deleting your local data through app settings

8.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse or misuse the Service

8.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. All locally stored data will be deleted when you uninstall the app. Subscription charges already paid are non-refundable except as required by law.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OctaCoach operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Displaying an in-app notification for material changes

Your continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

11. Miscellaneous

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OctaCoach regarding the Service.

11.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11.3 Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or our right to enforce it in the future.
